1. Introduction & Acceptance
These Terms & Conditions ("Terms") govern access to and use of the BookMyRun platform, including its Event Listing & Ticketing services and Timing Services (collectively, the "Platform"). The Platform is owned and operated by Fitskol Private Limited ("Fitskol", "BookMyRun", "we", "us", or "our").
By accessing, browsing, registering on, or using the Platform, whether as an Event organizer ("Organizer") or event participant ("Participant" or "User"), you acknowledge that you have read, understood, and agree to be legally bound by these Terms, the Privacy Policy, and any Event specific terms.
If you do not agree, you must discontinue use of the Platform immediately.
2. Nature of Platform Services
BookMyRun is a technology-enabled listing, ticketing, marketing, and timing services platform. Unless expressly stated otherwise:
- BookMyRun does not organize, host, manage, or execute Events; Unless explicitly stated.
- All Events are conceptualized, organized, conducted, and controlled solely by the respective Organizers;
- BookMyRun acts only as a facilitator for Event discovery, registration, payment collection (on behalf of Organizers), marketing tools, and timing services where contracted.
No fiduciary, partnership, agency, joint venture, or employment relationship is created between BookMyRun and any Organizer or Participant.
3. Organizer Terms
3.1 Event Listings
Organizers may list endurance and sporting events including, but not limited to, marathons, walkathons, triathlons, cycling events, swimming events, and allied activities, subject to Platform approval.
3.2 Organizer Responsibilities
Organizers acknowledge and agree that they:
- are solely responsible for Event planning, permissions, safety, medical arrangements, execution, and completion;
- are responsible for the accuracy, completeness, and legality of all Event information published;
- bear full liability for participant safety, injuries, losses, cancellations, or disputes;
- shall comply with all applicable laws, regulations, and governmental permissions;
- are solely responsible for refunds, cancellations, and Event-related communications.
3.2 Data Access & Marketing
Organizers may access Participant registration data strictly for Event-related purposes. Use of BookMyRun’s marketing services and databases is subject to separate commercial arrangements and Participant consent.
4. Participant Terms
4.1 Registration & Eligibility
Participants must provide accurate, complete, and current information. Eligibility, age limits, and category criteria are defined by the Organizer.
4.2 Minors
- Participation by minors is permitted only if expressly allowed by the Organizer.
- Registrations for minors must be completed by a parent or legal guardian.
- The guardian assumes full responsibility and liability for the minor’s participation.
- BookMyRun does not verify age or guardian consent.
4.3 Medical Fitness & Assumption of Risk
Participants confirm that they are medically fit and understand that endurance events involve inherent risks. Participation is entirely at the Participant’s own risk.
5. Payments & Fees
5.1 Ticket Payments
All registration fees are collected through third party payment gateways on behalf of Organizers. BookMyRun does not store payment card details.
5.2 Booking Fees
- BookMyRun charges a non refundable booking / service fee per ticket.
- Additional charges may apply for optional services.
6. Refund & Cancellation Policy
6.1 Refunds
- All refunds are governed solely by the Organizer’s stated refund policy.
- Booking fees and platform charges are strictly non refundable.
- BookMyRun is not liable for refusal, delay, or failure by an Organizer to issue refunds.
6.2 Cancellations & Changes
If an Event is cancelled, postponed, modified, or rescheduled for any reason (including force majeure), BookMyRun shall not be liable for any losses or damages. Participants must rely exclusively on the Organizer’s policies.ḍ
7. Timing Services & Results
7.1 Timing Services
Where BookMyRun provides on ground timing services, results are generated using electronic and manual systems.
7.1 Results Publication
- Results may be published under the “My Race Result” section.
- Published data may include name, bib number, category, timing, and rank.
- Results are provided on a best effort basis without warranty of absolute accuracy.
BookMyRun shall not be liable for ranking disputes, qualification claims, or timing discrepancies.
8. Force Majeure
BookMyRun shall not be liable for any failure or delay caused by events beyond reasonable control, including but not limited to acts of God, natural disasters, pandemics, government orders, strikes, network failures, or security incidents.
9. Intellectual Property
All Platform content, trademarks, software, and data are owned or licensed by BookMyRun. Unauthorized use is prohibited.
10. Limitation of Liability
To the maximum extent permitted by law:
- BookMyRun shall not be liable for indirect, incidental, consequential, or punitive damages;
- Aggregate liability shall not exceed the booking or service fees actually received by BookMyRun for the specific transaction.
11. Indemnity
Users agree to indemnify and hold harmless BookMyRun, its directors, employees, and partners against all claims arising from breach of these Terms, Event participation, or Organizer actions.
12. Termination
BookMyRun may suspend or terminate access without notice for breach, misuse, fraud, or legal requirements.
13. Governing Law & Jurisdiction
These Terms shall be governed by the laws of India. Courts at Mumbai, Maharashtra shall have exclusive jurisdiction.
